Terms of Service

1. Service Description

AURA is an AI-powered image generation application available exclusively on iOS. The service allows users to upload face and body photos, create a personalised avatar, browse over 1,000 curated styles, and generate photorealistic images within seconds. By accessing or using AURA, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the app.

2. Account Terms

  • You must sign in using your Apple ID to access AURA. We do not offer alternative login methods at this time.
  • You must be at least 13 years of age to create an account and use the service. If you are under 18, you must have permission from a parent or legal guardian.
  • You are solely responsible for maintaining the security of your account and for all activity that occurs under your account.
  • You agree to provide accurate and complete information when creating your account and to keep this information up to date.

3. Acceptable Use

When using AURA, you agree not to:

  • Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Use the service to create content that infringes on the intellectual property rights of any third party.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the application.
  • Scrape, crawl, or use any automated means to access the service or extract data from it.
  • Use the service in any way that could damage, disable, overburden, or impair our servers or networks.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

4. Content Ownership

  • Your uploads: You retain full ownership of any photos you upload to AURA. By uploading content, you grant AURA a limited, non-exclusive licence to process your photos solely for the purpose of generating images.
  • Generated outputs: AURA retains rights to AI-generated outputs and may use them for display, marketing, and promotional purposes. You are granted a non-exclusive, worldwide, royalty-free licence to use, download, share, and display the generated images for personal and commercial purposes.
  • Restrictions: You may not claim that AI-generated images are original photographs. You must not use generated images in a manner that violates any applicable law or these Terms.

5.Subscriptions & Payments

  • Free tier: Every new user receives 20 free credits upon signing up. These credits can be used to generate images at no cost.
  • Subscription plans: Additional credits and premium features are available through subscription plans, which are handled exclusively via Apple In-App Purchase. All billing, payment processing, and subscription management are conducted through Apple.
  • Pricing: Pricing is subject to change at any time. We will provide reasonable notice of any pricing changes through the app or via email.
  • Refunds: All refund requests are handled by Apple in accordance with App Store policy. AURA does not process refunds directly. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.
  • Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.

6. AI-Generated Content Disclaimer

  • AURA uses artificial intelligence to generate images. Results may vary based on the quality of uploaded photos, the selected style, and the inherent limitations of AI technology.
  • We do not guarantee an exact or perfect likeness in any generated image. AI-generated outputs are artistic interpretations and should be treated as such.
  • You must not use AURA to create deepfakes, impersonate real individuals without their consent, or generate content intended to deceive, defraud, or mislead others.
  • AURA reserves the right to remove any content that violates these guidelines and to suspend or terminate accounts engaged in misuse.

7. Service Availability

AURA is provided on a "best effort" basis. While we strive to maintain consistent uptime, we do not guarantee uninterrupted or error-free access to the service. The service may experience downtime due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

8. Account Deletion

You may request deletion of your account and associated data at any time through the app settings or by contacting us at support@auraimage.app. Upon receiving a valid deletion request, we will delete your account and all associated personal data within 30 days. Please note that some data may be retained as required by law or for legitimate business purposes, such as fraud prevention and legal compliance. Deletion of your account is permanent and cannot be reversed.

9. Limitation of Liability

To the fullest extent permitted by applicable law, AURA and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; or (d) unauthorised access, use, or alteration of your transmissions or content. In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless AURA, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any content you upload, generate, or distribute through the service.

11. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. When we make changes, we will notify you through the app or via email and update the "Effective date" at the top of this page. Your continued use of AURA after such changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the service and delete your account.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
